We want you to love your artwork.  If, however, you are not completely satisfied with your purchase, you may return the item (excluding commissions) within 30 days of receiving it for exchange or credit ONLY, towards other Sparking The Muse artwork, whether that is already-finished artwork or a commission.

 You may return the artwork, provided that it is returned to us in its original, unused condition and packaging.  Shipping costs will not be refunded. 

 Please contact Sparking The Muse and let us know of your decision before you ship, and we will send you an address to send it to.  At time of shipping, insure the artwork for the full value with tracking capability.  Returns lost in return shipping will not be refunded.  Upon Sparking The Muse’s receiving of the artwork, credit issued will include only the artwork purchase price, but will not include original shipping and insurance charges. 

 We reserve the right to not accept a return and may require a re-stocking or repair fee if the item has been at all damaged or worn.

 We will do everything we can to work with you and make sure your experience with us is positive.

Produced Artwork:

 1. Product: Once ordered and paid for in the store, the artwork will be shipped to the client, in protective packaging, using either USPS, FedEx or UPS. 

 2. Payment: All artwork must all be paid for in full up front in the store. The currency accepted is USD.  The payment is accepted by either PayPal or by credit card, in the Shopping Cart.  See “Commissions” below for payment of commissions.  

 3. Warranties: if you are not satisfied with your artwork, it can be exchanged for another artwork or a commission (please see our full Return Policy).  Changes will not be made to an existing artwork. 

 4. Deadlines: The artist will deliver product via USPS, FedEx or UPS, with appropriate costs for faster delivery times, if requested.  The client will pay for shipping option at time of order, in the Shopping Cart. 

 5. If one of us fails: If the client fails to pay, the artwork will not be delivered, and the transaction will be cancelled. If payment by the client is received and the artist fails to ship the artwork within 30 days, a refund will be given and the transaction will be cancelled.

 6. Law that governs this contract:

 COPYRIGHT / USAGE POLICY

 The artist holds every right to the produced artwork, and therefore is allowed to:

 -Use the copyrighted artwork to promote herself within any place or on any site

-Publish the artwork

-Display the artwork

-Post the artwork on websites and social media

The client is allowed to use the copyrighted artwork for personal use only, unless agreed otherwise. If the client infringes on the copyright in any way, every right that the client had to the artwork will be retracted.

 

The following is considered Copyright infringement:

 -Reproducing/selling the copyrighted artwork or any facsimile thereof

-Taking credit for the creation of the artwork

-Removing any watermarks/signatures

-Altering the artwork without the artist’s consent

 

7. Dissolving the agreement:

The client must request a dissolution of the agreement in writing.  Upon receipt of the request, the artist will issue a written receipt of cancellation, issuing an exchange with a different artwork or credit (in the amount of the price of the artwork) towards a commission.  If already in possession of the artwork, the client will ship the artwork back to the artist.  If the artwork has not yet been shipped to the client (in the case of already-produced artwork), no further actions are needed to end the transaction. 

 

Commissions:

Product: Once negotiated, ordered and paid for, the commission will be started.  The artist will periodically send photos of the commission-in-progress to the client for approvals.  Once final approval is given to the artist and the commission is completed, it will be shipped to the client, in protective packaging, using either USPS, FedEx or UPS. 

 2. Payment: All commissions must all be paid for in full up front. The currency accepted is USD.  The payment is accepted by either PayPal, by credit card, by Venmo, or by personal check. 

 3. Warranties: if you are not satisfied with your commission, it can be exchanged for another artwork or another commission (please see our full Return Policy).

 4. Changes: It is vital that the artist and the client communicate clearly during the commission process, in order to be sure that the artist is producing what the client has asked for.  During this process, changes are normal, expected, and part of the process.  However, after a commission has been given final approval by the client and is completed, only small changes are allowed to be made (anything that can be easily drawn or painted over).  Any great changes will come with an extra charge depending on time spent on it (anything that makes the artist have to redraw or repaint it completely).
